These Terms of Service (“Terms”) govern your access to and use of the Unique by Nature Co. website and the purchase of products from us. Throughout these Terms, “we”, “us”, and “our” refer to Unique by Nature Co., and “you” refers to the customer.

By accessing our website or placing an order, you agree to these Terms, together with our Privacy Policy and Returns & Refund Policy. If there is any inconsistency between these documents, the Returns & Refund Policy and Privacy Policy will apply to the relevant subject matter.

These Terms apply to orders delivered within Australia only.

1. Product Information & Fulfilment

Unique by Nature Co. is an online retailer. While we curate and sell the products available on our website, we do not manufacture the items ourselves.

Our products are sourced from carefully selected third-party partners who are responsible for product design, manufacturing, safety standards, and compliance with applicable regulations. Orders are dispatched from Australian warehouse locations, allowing us to offer a broader range of products and efficient delivery to most areas.

Product descriptions, specifications, and images on our website are provided based on the information available at the time of listing. We take reasonable care to ensure accuracy; however, minor variations in materials, colours, finishes, dimensions, packaging, or presentation may occur. Product images are for illustration purposes only and may be updated from time to time.

By placing an order with us, you acknowledge that:

  • Products may be supplied and dispatched by our fulfilment partners

  • Product information is based on manufacturer or supplier data

  • Minor variations that do not affect product functionality are not considered faults or grounds for return

Regardless of how an order is fulfilled, Unique by Nature Co. remains your primary point of contact for all customer enquiries, support, returns, refunds, warranty claims, and your rights under Australian Consumer Law.

2. Eligibility & Use of Website

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order.

You agree to use our website lawfully and not to engage in any activity that disrupts, damages, or interferes with the website or its security.

3. Orders & Acceptance

When you place an order, you are making an offer to purchase products at the listed price, including any applicable delivery fees.

Orders are considered accepted once processing has commenced. We reserve the right to decline or cancel orders if:

  • Payment cannot be processed

  • A product becomes unavailable

  • We identify an error or suspect misuse or fraud

Please review your order details carefully before checkout. Changes may not be possible once processing has begun.

4. Prices & Payments

All prices are shown in Australian Dollars (AUD) and include GST where applicable.

Payment must be made in full at checkout. Payments are processed securely via third-party payment providers. We do not store or have access to your full credit card details.

Discount codes must be applied at checkout and cannot be added after purchase. Unless stated otherwise, discounts do not apply to delivery fees and only one discount code may be used per order.

5. Shipping & Delivery

We deliver to most Australian addresses using the delivery details provided at checkout.

Delivery timeframes are estimates only and may vary due to location, courier availability, or external factors beyond our control. Deliveries are made to ground-level access points and do not include unpacking, assembly, or removal of packaging.

Where Authority to Leave (ATL) is used, responsibility for the order passes once delivery is completed. We are not responsible for loss, theft, or damage after delivery where ATL has been authorised.

6. Cancellations & Order Changes

Orders may be cancelled only if they have not entered processing.

Where a cancellation is approved:

  • A cancellation or administrative fee of up to 10% may apply

  • Alternatively, store credit may be offered at our discretion

Once an order has entered processing or dispatch, cancellation is no longer possible and the order will be treated as a change-of-mind return.

Delivery address changes cannot be guaranteed once processing begins. Any additional costs caused by incorrect or incomplete address details will be the customer’s responsibility.

7. Change of Mind Returns & Fees

Change-of-mind return requests must be submitted within 7 days of delivery and are subject to our Returns & Refund Policy.

For approved change-of-mind returns:

  • Original delivery fees are non-refundable

  • Return shipping costs are the customer’s responsibility

  • A 10% restocking fee will be deducted from the refund

Returned items must be unused, unassembled, and in original packaging. Certain items are excluded from change-of-mind returns. Full details are set out in our Returns & Refund Policy.

8. Damaged, Faulty or Incorrect Items

Please inspect your order upon delivery. If an item arrives damaged, faulty, missing parts, or incorrect, you must contact us within 48 hours and provide clear photo or video evidence.

Claims cannot be assessed without adequate visual proof. Damage to external packaging alone does not qualify for a return if the product itself is unaffected.

Some orders may arrive in multiple parcels. Please check tracking details before reporting missing items.

9. Assembly & Product Care

Many products require assembly. Instructions are provided where applicable.

You are responsible for assembling products correctly and using appropriate tools. Damage caused by incorrect assembly, misuse, or failure to follow instructions is not covered by warranty or refund.

10. Warranties

Most products include a 12-month warranty covering manufacturing faults under normal domestic use, unless otherwise stated on the product page.

The warranty does not cover:

  • Normal wear and tear

  • Incorrect use, assembly, or maintenance

  • Damage caused by misuse or modification

  • Cosmetic imperfections that do not affect functionality

Do not dispose of any item before a warranty claim has been assessed. All warranty claims are handled in accordance with Australian Consumer Law.

11. Refunds & Processing Timeframes

Approved refunds are issued to the original payment method following inspection and approval.

  • Return inspections may take up to 5 business days

  • Refunds are processed within 5 business days of approval

  • Banks and payment providers may require additional time to finalise funds

Refund amounts will be adjusted to reflect applicable delivery fees, restocking fees, and return shipping costs, as outlined in our Returns & Refund Policy.

12. Intellectual Property

All content on our website — including text, images, designs, logos, and product descriptions — is owned by or licensed to Unique by Nature Co. and protected by intellectual property laws.

You may not copy, reproduce, distribute, or commercially use any content without our prior written consent.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, or delays caused by events beyond our reasonable control.

Our total liability is limited to the amount paid for the product in question, except where Australian Consumer Law provides otherwise.

14. Indemnity

You agree to indemnify and hold harmless Unique by Nature Co. from any loss, claim, or expense arising from your breach of these Terms, misuse of our website or products, or unlawful conduct.

15. Events Beyond Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, courier disruptions, strikes, pandemics, or system outages.

16. Account Security

If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. Notify us immediately of any unauthorised use.

17. Safe Use of Products

Products must be used only as intended and in accordance with provided instructions. We are not liable for injury or damage resulting from improper use or unauthorised modification.

18. Dispute Resolution

If a dispute arises, please contact us first so we can attempt to resolve it promptly. Mediation may be proposed before legal proceedings, without limiting either party’s right to seek urgent legal relief.

19. Governing Law

These Terms are governed by the laws of Queensland, Australia, and you submit to the exclusive jurisdiction of the courts of Queensland.
